Brazil. The Brazilian Association of Refrigeration, Air Conditioning, Ventilation and Heating, Abrava, launched for the market a guide of regulatory recommendations called: Renabrava 7, which has 22 questions and answers with frequently asked questions regarding compliance with Law 13.589 / 2018, on air conditioning maintenance, also known as PMOC Law (Maintenance, Operation and Control Plan).
For the president of Abrava, Arnaldo Basile, this is an official document of the Association, which aims to guide professionals in the air conditioning sector on the applicability of Law 13,589 with recommendations on its compliance.
For Paulo Rosenthal, Legal Director of Abrava, the rules of the PMOC are clear, once the Resolutions and other Norms of the Anvisa are valid, and have not been revoked, and therefore, must be followed, once endowed with the force of Law, that is, of mandatory observance. In any case, the expectation is that the Regulatory Decree should be published shortly, Rosenthal concludes.
This Law obliges all facilities for public or collective use to have a PMOC of the air conditioning system, and must meet and observe the regulatory and quality parameters regulated by the National Health Surveillance Agency (ANVISA) and the Standards of the Brazilian Association of Technical Standards (ABNT). Among the penalties provided for in the Law, there are penalties of R$2,000.00 up to R$1,500,000.00, being doubled in recidivism, in addition to civil penalties.
The 22 questions and answers were compiled among the hundreds of queries sent to the PMOC channel, created by ABRAVA to clarify doubts of professionals in the sector and agents involved in the process. The responsibility for the answers is in charge of professionals specialized in the PMOC theme.
